Data Protection Commissioner

Public and non-public organisations that process personal data automatically must order a data protection commissioner in writing. (§ 4 f Abs. 1 BDSG).

 

Duties

  • Control of the application of the law (§ 4 g para. 1 sentence 1 BDSG)
  • Control of the program application (§ 4 g para. 1 sentence 2 No. 1BDSG)
  • Informing the employees working on the processing of personal data about the relevant regulations (§ 4 g p BDSG)


Position

There is currently no explicit provision in the BDSG. For internal commission there is a line positionr ecommended. An external order, as data protection representative in a impartial position in direct assignment of the management is permissible.
